By placing an order with AUGET (“AUGET”, “we”, “us”, “our” or “our”) for products that are sold on the Site (“Products”), it will be considered that you have read, understood and accepted these general conditions of sale of products online (“General Conditions of Sale”). Please read them carefully and, if you are not satisfied with their content, we advise you to contact our Customer Service before placing any orders with us.
We may make changes to these General Terms and Conditions of Sale at any time. To know the date of the last update of these General Terms and Conditions of Sale, please refer to the top of the page. Each time you order Products from us, the General Terms and Conditions of Sale in force on the date of the order will apply to the contract concluded between you and us. If we need to amend these General Terms and Conditions of Sale and if this has a significant impact on your order, we will contact you to inform you of the changes made sufficiently in advance and the procedure to follow to cancel the contract if they do not satisfy you.

Eligibility
To make a purchase via the Website or to use any of the services or features we provide on the Website, you will need to create an account. When you register, you will be required to provide us with information about yourself, including your name, telephone number and e-mail address, which must be accurate, current and complete in all respects. If you change the information you provided when you registered, you will need to immediately change your online account. We may make changes to the registration conditions at any time. In addition, when ordering, you will need to provide bank details. You hereby declare and guarantee that the bank details provided with any order are both valid and correct and that you are the person whose name appears on the invoicing documents transmitted.
The purchase of Products via the Website is strictly limited to persons who can legally enter into contracts on the Website in accordance with French law.
Pricing policy
We have taken particular care in preparing the content of this Website, in particular to ensure that the details, descriptions and prices mentioned when it was put online are accurate. However, we will only accept orders if there is no material error in the description of the Products or their prices as they appear on the Website. All prices include VAT and exclude shipping costs. The total amount of your order is the amount of the Products ordered plus VAT at the rate then in effect and the delivery charges mentioned during the payment process.
We do not debit your bank account until we have shipped your order. The prices of the products in your shopping cart will always be identical to the most recent prices as they appear on the page containing detailed information about the Products.
Please note that no VAT exemption will be granted for an online order. We invite you to contact us for any additional information you may require.
Availability
All Products are offered subject to availability. The rates as they appear on our Website will apply as long as the Products are available or for any period specified on it. We will inform you as soon as possible if the Products you have ordered are not available.
Order errors
You can correct any incorrect orders until you click on the “Place Order” button (or equivalent) on the last page of the order process.
Confirmation and acceptance of your order
We will send you an order confirmation containing an order number by e-mail as soon as possible. If we are unable to fulfill your order after confirming it, we will notify you by email or telephone. We will confirm the acceptance of your order in an email that will inform you that the products have been shipped (“Shipping Confirmation”). A legally binding contract between you and us will be entered into when sending the Shipment Confirmation (or, in the unlikely event that, due to a processing error, no Shipment Confirmation has been sent, when shipping the Products by us) (“Contract”). If you would like to receive information about your order, please write to us at [email protected] with your order number. We may refuse your order if the product you wish to purchase is no longer in stock, if we have identified an error regarding an item or if we are unable to obtain authorization for your payment.
Pre-order
In the event of a shortage of available stocks or a refusal to authorise payment by the banking institutions, AUGET reserves the right to cancel or suspend any pre-order until it is dispatched. The express delivery option is not available for a pre-order.
Shipping & Returns
Deliveries can only take place in metropolitan France (which includes Corsica and Monaco but excludes overseas France). Our delivery methods may not all be available throughout metropolitan France. If you have any questions about delivery outside metropolitan France, we advise you to contact our Customer Service on +33 (0)1 XXXXXX.
We deliver the Products in accordance with the delivery method you have chosen. When used, the term “working day” excludes Saturdays, Sundays and public holidays. Upon delivery of the Products, we will provide you with sufficient information to enable you to exercise your legal right of withdrawal and to send any request for withdrawal to the appropriate recipient or to return the Products. For more information, please consult the sections on returns and the right of withdrawal of these General Terms and Conditions of Sale.
If offered, free shipping will only apply to standard shipping. 24-hour delivery, express delivery and international delivery are excluded from this offer. We will make every effort to deliver the ordered Products within 3 to 8 working days from the date of conclusion of the Contract.
Inspection
You must inspect the Products upon receipt and verify that everything mentioned on the delivery note is present. We will consider you to have accepted the order unless you notify us otherwise (and return the Products to us in accordance with your right of withdrawal or any other legal right (as set out in clauses 11 and 12 below).
Your right of withdrawal
As a consumer, you have the legal right to withdraw from a Contract within 30 days of delivery of the Products. This means that during this period, if you change your mind or decide, for any reason whatsoever, that you do not wish to keep a Product, you can notify us of your decision to cancel the Contract and receive a refund. Your right to return Products to us applies to Products on sale.
Your right to return items to us does not apply to Products (i) manufactured to your specifications; or (ii) that have been visibly customized or (iii) that, by their nature, cannot be returned or are unlikely to deteriorate or reach their expiry date quickly or (iv) that are packaged and cannot be returned for protection or hygiene reasons, if they have been unpacked upon delivery.

If you retract within 30 days from the date of delivery of the products:
(a) You must return them to us as soon as possible (in their original and unopened packaging) and at the latest within 14 days of the day on which you notified us of your wish to terminate it;
(b) In the event of sending by post, we recommend that you request proof of shipment since we do not assume any responsibility for Products lost during shipment;
(c) We will refund you the price of the Products. However, please be aware that your refund may be reduced to take into account any devaluation of the Products if you have handled them in a manner that would not be authorized.
(d) We will refund you for the delivery charges you have paid, although, as permitted by law, the refund is offered under our Refund Policy.
(e) If you cancel your order but do not return the Products to us within 14 working days of notification of your wish to cancel the order, we will be entitled to retain the amount of the refund.
Your other rights to return Products
Remember that when we accept your order for products on this website, you enter into a legally binding contract.
We are committed to delivering Products that are in conformity with those you have ordered. As a consumer, you have legal rights if the Products are defective or do not conform to their description.
In particular, we are subject to the conditions of legal guarantees provided for in Articles L. 217-4, L. 217-5 and L. 217-12 of the Consumer Code and Articles 1641 and 1648 of the Civil Code.
These rights (which are generally summarized below) do not affect your right to choose to return the Products and obtain a refund under Clause 11 above or to exercise any other provision hereof.
If the Products do not conform, you may refuse delivery or return them to us in their original packaging, indicating the reason for refusal on the delivery note or invoice, the costs being at our expense.
You may request the repair of the Products or a new delivery in accordance with your order. If repair and replacement is not possible, you may request cancellation of the Contract and refund of the sums paid or retain the Products by requesting a reduction in their price. Under certain conditions, you can, in accordance with the law, take legal action against hidden defects, or have a possible commercial guarantee applicable to your order.
However, we cannot be held liable if the non-performance of the Contract or its improper performance is due to an action on your part, an unforeseeable and insurmountable event by a person outside the Contract (our service providers are not considered as such), or a case of force majeure.
Our liability if you suffer loss or damage
We are liable to you for any foreseeable loss or damage caused by us. If we do not comply with the provisions hereof, we are liable for any loss or damage suffered by you as a foreseeable result of non-compliance herewith or a breach of an obligation that you could reasonably have expected from a professional. Losses or damages are foreseeable either if it is obvious that they will occur or if, at the time the Contract is concluded, we and you knew that they were likely to occur, for example if you discussed them with us during the sale process.
We do not exclude or limit, in any way, our liability to you if this is contrary to law. This includes liability for death or personal injury caused by our negligence or that of our employees, agents or subcontractors.
We only deliver Products for domestic and private use. You agree not to use the Products for commercial, professional or resale purposes and we assume no liability to you for any loss of profits, loss of business, interruption of business or loss of business opportunities.

If, after contacting us and at the end of the complaint procedure, you still feel that your complaint has not been resolved satisfactorily, you can call upon a mediator free of charge in accordance with Article L. 612-1 of the Consumer Code.

Transfer of rights
We may transfer our rights and obligations hereunder to another corporation and will always notify you in writing if this is the case but this will not affect your rights and obligations hereunder. You may only transfer your rights and obligations hereunder to another person if we have accepted it in writing.
Applicable law, Jurisdiction and Language
The Website, any content on it and any contract concluded as a result of its use are governed by French law. The parties agree to submit any dispute to the exclusive jurisdiction of the courts of Paris, France. All contracts are concluded in French.
